Service Description
New Mexico Pest Control provides professional pest management and wildlife control services throughout the State of New Mexico. Our services include, but are not limited to, residential and commercial pest control treatments, termite inspection and treatment, rodent exclusion, bed bug remediation, bird control, and integrated pest management programs. Service frequency, treatment methods, and coverage areas are determined based on individual property assessments, environmental conditions, and the specific pest pressures identified during initial inspection. All service agreements are documented through written proposals or work orders that specify the scope of work, scheduled treatment dates, and applicable fees. We utilize EPA-registered products and employ licensed technicians who follow industry best practices and New Mexico regulatory requirements. Weather conditions, seasonal pest activity patterns, and property-specific factors may affect treatment timing and efficacy. Customers will be notified of any necessary schedule modifications due to adverse weather or other circumstances beyond our reasonable control.
No Guarantee or Warranty
New Mexico Pest Control does not guarantee the complete elimination of pests from any treated property. Pest control results vary based on numerous factors including, but not limited to, property construction, surrounding environment, neighboring conditions, customer cooperation, and the biological characteristics of target pest species. No warranty, express or implied, is provided regarding the permanent or long-term absence of pests following treatment. Reinfestation may occur due to conditions outside our control, including new pest introductions from adjacent properties, structural deficiencies that create entry points, or changes in customer behaviors that attract pests. Any follow-up treatments or retreatments are provided solely at the discretion of New Mexico Pest Control and may require additional fees unless explicitly covered under a separate maintenance agreement. Our service warranties, where offered, are limited to the specific terms and duration set forth in individual written contracts and do not extend beyond those expressly stated conditions.
User Responsibilities
Customers must provide accurate and complete information regarding property conditions, existing pest problems, previous treatments, and any known hazards prior to service commencement. You are responsible for preparing the service area according to our provided instructions, which may include removing pet food and water dishes, covering aquariums, securing pets, clearing access to treatment areas, and vacating premises for specified periods when required. Failure to follow preparation guidelines may result in treatment delays, additional charges, or reduced treatment effectiveness. You must promptly report any pest activity between scheduled services and maintain the structural integrity of your property, including sealing gaps, repairing screens, and addressing moisture issues that contribute to pest problems. Customers must notify us of any changes in property use, renovations, or new conditions that may affect pest management strategies. Payment is due according to the terms specified in your service agreement, and delinquent accounts may result in service suspension and collection activities. You agree to grant our technicians safe and reasonable access to all areas requiring treatment during scheduled appointment windows.
Limitation of Liability
To the fullest extent permitted by applicable law, New Mexico Pest Control and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to our services, including but not limited to property damage, personal injury, lost profits, business interruption, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. Our total cumulative liability for any claims related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the event. This limitation applies to all causes of action, including breach of contract, tort, negligence, strict liability, and any other legal theory. We are not responsible for damage to personal property, landscaping, or structures resulting from pre-existing conditions, customer failure to follow instructions, or acts of third parties. You acknowledge that pest control treatments involve inherent risks and agree to assume responsibility for ensuring the safety of occupants, pets, and visitors during and after service application.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on our website, marketing materials, and documentation are the exclusive property of New Mexico Pest Control or its licensors and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent. Any feedback, suggestions, or ideas you provide regarding our services may be used by us without restriction or compensation to you. Our service methodologies, treatment protocols, and proprietary formulations constitute trade secrets, and you agree not to disclose or use such information for any purpose other than receiving the contracted services.
Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these terms or our services shall be instituted exclusively in the state or federal courts located in Bernalillo County, New Mexico. You hereby waive any objection to jurisdiction and venue in such courts and agree not to bring any claim in any other forum. The provisions of the New Mexico Uniform Arbitration Act shall apply to any dispute subject to arbitration as agreed by the parties. If any provision of these terms is held invalid or unenforceable under New Mexico law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Changes to Terms
New Mexico Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason in our sole discretion. Material changes will be communicated through direct notice to active customers via email or postal mail, and updated terms will be posted on our website with the revised effective date. Your continued use of our services following notification of changes constitutes acceptance of the modified terms. If you do not agree to the revised terms, you must discontinue using our services and notify us in writing to terminate your service agreement. We encourage you to review these terms periodically to remain informed of any updates. Changes will not apply retroactively to disputes or incidents that arose prior to the effective date of modification.
